1. Definitions
• Services
Programmable interactive AI agents for customer communications via web chat, social-media bots, phone and audio calls, delivered through the ANITA24 platform.
• Providing Organization
A legal entity that purchases Services from Luminata and deploys AI agents on its properties (e.g., website, social channels).
• End User
Any person who interacts with an AI agent on behalf of a Providing Organization.
2. Scope of Agreement
By using or accessing our Services (including embedding our web chat on your site), you agree to these Terms. End Users must also comply with the Providing Organization's own terms and policies.
3. Use of Services
• Eligibility & Cost
- End Users access the chat for free. Providing Organizations pay all fees.
- End Users do not register or create accounts; interactions are identified only by ephemeral session IDs.
• Permitted Uses
Communicating in good faith with AI agents to obtain information, support, or complete transactions.
• Prohibited Conduct
End Users must not upload or transmit content that is: unlawful, offensive, infringing, discriminatory, misleading, AI-generated without disclosure, or otherwise prohibited.
4. User-Generated Content & Attachments
- All text, files, images, or other materials End Users submit ("User Content") become part of the chat transcript.
- Providing Organizations own all transcripts, attachments, and derivative data.
- Luminata may access data only as described in our Privacy Policy.
5. Consent & Privacy
- End Users provide implied consent to process their chat data as described in our Privacy Policy.
- Providing Organizations are responsible for obtaining explicit consent whenever required by local law.
- End Users may request a platform-wide block at any time by emailing support@anita24.com.
6. Data Security
- All chat data and attachments are encrypted in transit and at rest.
- Access is strictly limited to:
- Authorized technical staff at Luminata (under rigorous protocols)
- The Providing Organization that deployed the agent
7. Intellectual Property
- Luminata retains all rights, title, and interest in the Services, software, APIs, documentation, branding, and infrastructure, except for any logos or trademarks supplied by a Providing Organization.
- Providing Organizations retain all rights in their data—transcripts, attachments, customized knowledge bases, and any derived analytics.
- End Users grant Providing Organizations and Luminata a worldwide, royalty-free, sublicensable license to use, reproduce, modify, and analyze their User Content solely to operate and improve the Services.
8. Service Disclaimers & AI-Generated Content
- The Services rely on Generative AI technology, which may occasionally produce misleading, incorrect, or outdated information.
- Luminata and Providing Organizations encourage reporting of any problematic output to support@anita24.com for review and mitigation.
- No Guarantee: We do not warrant that the AI's responses will always be accurate, complete, or suitable for any particular purpose.
9. Limitation of Liability
To the fullest extent permitted by law, neither Luminata nor its affiliates, officers, or partners shall be liable for any:
- Direct, indirect, incidental, special, consequential, or punitive damages
- Loss of revenue, data, or goodwill
- Errors in AI-generated content or service interruptions caused by third-party dependencies
This limitation applies even if Luminata has been advised of the possibility of such damages.
10. Termination
- We may suspend or terminate access to the Services at any time for breach of these Terms, at our discretion.
- Upon termination, Luminata will cease to provide Services, and End Users will lose access to chat. Providing Organizations remain responsible for their data retention obligations.
11. Privacy Policy
Our practices are described in the separate Privacy Policy. By using the Services, you confirm you've read and accept that policy, which covers:
- What data we collect and why
- How data is encrypted, stored, and accessed
- Retention periods and user rights

12. Dispute Resolution & Remedies
- Notice: All legal notices shall be sent to Admin@anita24.com.
- Remedies: In the event of any dispute or request (e.g., removal of personal data, correction of false or outdated information), Luminata may—in its discretion—take corrective actions (data removal, update, etc.) so long as they comply with applicable law and our objectives.
13. Modifications to These Terms
We reserve the right to update these Terms at any time. Updated Terms will be posted on our website. It is the responsibility of Providing Organizations to notify their End Users of material changes.
14. Governing Law
These Terms are governed by the laws of Israel, without regard to conflict-of-law principles.
